Stewardship, Not Politics: Why We are Going to Court
March/April 2026
So, where do we preservationists go from here, after the City failed to follow environmental laws?
The City Council’s vote on February 26 triggered a necessary legal response. When elected officials disregard environmental law, bypass required analysis, and undermine long-standing safeguards, the courts become the forum of last resort.
Going to court is never our preferred path, but it is sometimes the only one left. Litigation has never been our first step. It is a measure reserved for circumstances when the law is clear, the public process has failed, and the consequences of inaction would be lasting and irreversible.
But litigation is neither simple nor inexpensive. If you believe San Diego’s historic places matter and that decisions affecting our shared heritage must comply with CEQA and the rule of law, now is the time to stand with us.
Please consider making a contribution to SOHO’s Legal Defense Fund. Preservation is not obstruction. It is stewardship. And stewardship requires vigilance.
SOHO undertakes this legal action responsibly, thoughtfully, and strategically. We litigate only when we are confident in the strength of our position and when preservation principles are at stake.
If you would like to support these efforts, contributions to our Legal Defense Fund are needed and are welcome.
We are sincerely grateful for the continued engagement and support of our members and coalition partners. Thank you!
